This privacy policy ("Policy") describes the information collected through the Website, the Platform, or any other website or mobile application upon which this Policy is posted (the "Site(s)") and the related products and services we provide, whether online or offline, and how that information is collected, used, and disclosed.
The Website, Platform, Site(s), our products and services (including any mobile applications, online platforms, application programming interfaces, and other software (the "Software")), and all related content, technology, and tools are, together, referred to as the "Services." We may collect or receive the types of information described below as a result of your access to and use of the Services (together, "Collected Information") by visitors and users ("you," "your," or "User"). This Policy applies to you and to all visitors to and users of the Services.
This Policy also explains your rights and choices regarding your personal information (if applicable), how we communicate changes to this Policy, and how you may contact us regarding questions or issues with respect to any matter addressed by this Policy. This Policy is incorporated into and made a part of our Services, our Subscriber Terms and Conditions, and any other agreement that references this Policy or governs access to or use of the Services (together, our "Terms").
The data controller of Collected Information is Tradara Terminal LLC (at the address and contact information set forth under the "Contact Us" section below) or such other data controller identified on the applicable website or mobile application on which this Policy is posted.
By accessing, browsing, or otherwise using the Services, by accepting or entering into our Terms, you agree on behalf of yourself and any organization or company that you represent (together, "you") that you have read and understand this Policy and that you consent to our collection, use, and disclosure of your personal information and other Collected Information pursuant to the terms of this Policy. If you do not agree with this Policy, do not access or use the Services.
1. Collection of Information
The information we collect generally falls into the following categories:
1.1. Information that you voluntarily submit to us ("Submitted Information"), for example, your contact information, account registration information, payment information, user-generated content, support requests, and job applications.
1.2. Information collected automatically through your use of the Services, for example, user activity, data collected by the servers used to operate the Services (such as IP addresses and device information), data collected by analytics providers, data collected when you connect using or share information via social media platforms, and data collected by cookies and similar tracking technologies.
1.3. Information we receive from third-party sources, for example, identity verification providers, brokerages and clearing firms, proprietary trading firms and evaluation providers through which you access the Services ("Firms"), market data vendors, and publicly available sources, as further described in this Policy.
2. Submitted Information
We will collect information that you choose to submit to us through, using, or in connection with the Services, including the types of information described below.
2.1. Identifying and Contact Information
You can visit certain portions of the Services without submitting your contact information to us, but you will be required to provide your contact information in order to sign up for or subscribe to the Services, to create an account or profile, to request information from us, to use certain Services or features, and to request customer support. We will collect any information from or about you that you choose to provide to us, which may include, without limitation, your full legal name, date of birth, email address, telephone number, postal address, and country of residence. We will use your information as described below in this Policy, including, without limitation, to provide the Services and their functionality, to set up and administer user accounts, to process orders for our Services, to verify that you meet our age and eligibility requirements, and to communicate with you for marketing and administrative purposes.
2.2. Accounts
To sign up for an account, you must provide specific information, including your full legal name, email address, a username, and a password. You may also be asked for additional information such as your country of residence and zip code or postal code. Once you are registered, we will collect your login information to facilitate your access to, and to administer, your account.
2.3. Phone Numbers
If you provide a mobile or other telephone number to us, you consent to receiving telephone calls and/or text messages from us, if and as applicable, as described in this Policy, but only to the extent permitted by applicable law.
2.4. Payment Information
Payments submitted in connection with the Services (including subscription fees, one-time fees, and any other charges) must be made via the Services using a credit card, debit card, or alternate payment method that is personal to you, where such alternate payment methods are made available as an option. Alternate payment methods may be provided by third parties (for example, Stripe, PayPal, or similar processors), subject to that third party's privacy policy. This Policy does not apply to such third party's collection and use of your information. With regard to credit and debit card payments, all credit and debit card information is provided directly to our third-party payment processor and must be made using a card personal to you. We do not directly access, handle, or store your full credit or debit card information. To submit payment using the Services, you will need to provide your full legal name, email address, telephone number, billing address, and your credit or debit card number, expiration date, and security code, as well as any other information necessary to verify the applicable payment. Our payment processor will use your payment-related information in accordance with its privacy policy.
2.5. Market Data Subscriber Information
Access to certain market data made available through the Platform requires that you provide additional information in order to comply with the entitlement and reporting requirements of the relevant exchanges and market data redistributors (including, without limitation, CME Group). This information may include your full legal name, residential address, country of residence, employment status, employer, professional/non-professional classification, registration status with regulatory authorities, and a signed market data subscriber agreement. We collect, retain, and disclose this information to the relevant exchanges and market data vendors as required by their licensing terms and applicable law. By subscribing to market data through the Services, you authorize us to share your subscriber information with the applicable exchange(s) and market data vendor(s), and you agree to be bound by the terms of the applicable exchange's subscriber agreement.
2.6. Sensitive Personal Information
In connection with the Services, we may collect information that is considered "sensitive" under applicable laws, including:
government-issued photo identification documents and identification numbers;
financial account information (such as bank account numbers, routing numbers, and related contact information); and
tax identification information (such as a taxpayer identification number) where required for compliance, billing, or reporting purposes.
We collect and use sensitive personal information for the following legitimate business purposes:
to carry out our obligations under applicable law (including anti-money laundering, know-your-customer, sanctions screening, tax, and exchange-licensing requirements);
for the performance of our agreement with you and to provide the Services requested by you and as reasonably expected in the context of such performance (for example, using a copy of a valid government-issued identification to verify your identity and to protect against fraud);
to protect our legal interests and to ensure the physical safety of ourselves and other individuals;
as otherwise required by law; and
for other purposes, with your prior consent.
If we have valid concerns about fraud or identity verification, as determined in our sole discretion and in alignment with applicable KYC requirements, we may submit your identity information to a third party for the purposes of identity verification. Please note that this Policy does not apply to such third parties' collection and use of the information you submit to them.
We do not sell your sensitive personal information, and we do not share your sensitive personal information for purposes of cross-contextual behavioral advertising.
2.7. User-Generated Content
We will collect all data, information, and other content that you enter into, submit to, upload to, or transmit using the Services, including any messages, support tickets, screenshots, charts, custom indicators or scripts, watchlists, alerts, layouts, and saved configurations. If you post a submission to any public-facing area of the Services (for example, public chat rooms, community forums, or shared layouts), please be aware that any personal information disclosed in such submission can be read, viewed, collected, or used by other users, and could be used to contact you, send you unsolicited messages, or for purposes that neither you nor we control. If you share a trade link or performance display, or participate in a Competition or leaderboard, your username, results, and related trading statistics may be visible to other users or to anyone with the link. You are responsible for any content you submit, and such content is provided at your own risk. We cannot guarantee that user-generated content will not be viewed by unauthorized persons. You understand that, even after removal, copies of user-generated content may remain viewable in cached and archived pages and may have been copied or stored by other users or by Internet archives.
2.8. Order, Position, and Trading Activity Data
When you connect a brokerage account to the Platform or otherwise route orders or receive account data through the Services, or when you trade in a simulated, evaluation, or Competition account, we collect information about your trading activity, including order entries and modifications, fills, working orders, positions, account balances, profit and loss, margin and risk metrics, copied orders and trade copier settings, and related metadata (such as timestamps, instruments, venues, and order routes). We use this information to provide the Services, to display your account state to you within the Platform, to operate features such as risk controls, analytics, and reporting, to troubleshoot and improve the Services, to detect and prevent fraud and abuse, and to comply with applicable law and the requirements of brokerages, exchanges, and regulators. For the avoidance of doubt, your trading account, the underlying funds, and the execution relationship are with the applicable brokerage or futures commission merchant, and not with Tradara Terminal. If you connect a brokerage account, we also collect and store the credentials, API keys, or access tokens needed to connect it, and we use them only to provide the Services.
2.9. Contact Forms and Requests for Information or Support
To contact us for more information, or to request support via the Services, you will need to provide your contact information as applicable, as well as details of the products or services you are interested in and the subject matter of your inquiry.

If you sign up or otherwise opt in to receive newsletter updates, promotional or marketing communications, or other communications from us, you will need to provide your email address. We will use this information to send you updates, marketing, promotional, and other electronic communications. You may opt out of receiving promotional emails from us at any time by following the unsubscribe instructions in the applicable email or by contacting us using the contact information provided below under "Contact Us." Note that, even if you opt out of receiving promotional communications, you may still receive administrative communications from us with respect to your account and use of the Services. We may use third-party email providers to deliver these communications.
2.12. Job Applications
If you submit a resume, job application, or related materials to us, we may use that information to evaluate your qualifications and consider or respond to your inquiry or application. Your submission of a resume, job application, or related information does not in any way require us to review that information or consider you for employment. To submit a job application, you may be redirected to an online career portal operated by a third party. We encourage you to review any terms and privacy policies posted on that portal.
3. Other Information Collected Automatically
As you navigate and use the Services, certain information is collected automatically using various technologies.
3.1. Usage, Device, and Location Data

We use this information to administer the Services and their servers, to generate statistical information, to monitor and analyze Service traffic and usage patterns, to monitor and help prevent fraud and abuse, to investigate complaints and policy violations, to enforce entitlement and licensing requirements (including for market data), to enforce eligibility and geographic restrictions (including sanctions and market data country restrictions, and detection of VPN or proxy use), and to improve the Services.
3.2. Cookies and Similar Tracking Technologies
See Section 5 ("Cookies and Tracking Technologies") below.
3.3. Information from Third-Party Sources
We may obtain information about you from the following sources:

Market Data Vendors and Exchanges. We receive market data from exchanges and licensed redistributors and may receive subscriber-related data and audit information from these sources.
Connected Services. If you link, connect, or log in to the Services using a third-party service or account (such as Google, Apple, or Microsoft single sign-on), the third-party service may send us information such as your profile information from that service. This information varies and is controlled by that service or as authorized by you in your privacy and security settings at that service.
Publicly Available and Social Media Data. This may include your contact information, employer, social media handles, and other information from publicly available sources.
4. Sharing and Use of Collected Information
In addition to the uses and sharing described above, we and our suppliers may use and disclose Collected Information as described below. We do not generally rely on or require your consent to allow us to process your personal data if there is another legal ground available. If we do rely on your consent, we will request it and make this clear to you at that time. We do not use, sell, rent, or otherwise disclose Collected Information except as stated in this Policy and as required or permitted by applicable law.

We will obtain your prior consent for such promotional communications solely to the extent required by applicable law. You may opt out of receiving promotional communications from us at any time by following the unsubscribe instructions contained in the applicable email or by contacting us using the contact information provided below under "Contact Us." Even if you opt out of promotional communications, you may still receive administrative communications.
4.4. Text Messages
If you opt in to receive text messages (SMS and MMS) on the Services when prompted, we may send you autodialed and other text messages at the telephone number you provide relating to your use of the Services. Consenting to receive text messages is not required to buy goods or services or to otherwise do business with us. Message and data rates may apply. You can opt out at any time by replying STOP.
4.5. Brokerages and Clearing Firms
When you connect a brokerage account, clearing relationship, or futures commission merchant to the Platform, you direct us to interact with and disclose your information, including your personal information, to the applicable brokerage, clearing firm, or futures commission merchant for the purpose of providing the Services. We are not a party to those agreements and are not responsible for the acts, omissions, solvency, execution quality, or regulatory compliance of any such third party. We encourage you to review the privacy policy of any brokerage, clearing firm, or futures commission merchant that you use in connection with the Services.
4.6. Firms
If you access the Services through a Firm, we share with that Firm your account and contact information, account identifiers, trading activity in your Firm-provided accounts (including orders, fills, positions, balances, profit and loss, and risk metrics), rule-monitoring results, platform usage, and market data subscriber status. We share this information so the Firm can operate its program, enforce its rules, provide you with support, and pay for your access. We will maintain such information in aggregate or deidentified form and will not attempt to reidentify it (except as may be necessary to determine whether the deidentification process satisfies applicable legal requirements).
4.13. Lawful Process; Protection of the Company
We may use and share Collected Information in accordance with and in response to regulatory authorities, courts of competent jurisdiction, valid law enforcement requests, governmental agency requests, emergency services, exchange regulatory bodies (such as CME Group's Market Regulation department), self-regulatory organizations, and other necessary third parties for legal, protection, security, and safety purposes (for example, to comply with laws or regulations, to respond to subpoenas and legal processes, to protect the safety of our employees, agents, and customers, or any other person). We may also use Collected Information and share it with third parties if we believe doing so is necessary or appropriate to protect our rights or the rights of others, including to enforce our agreements, policies, and Terms, to bring legal action, to protect our operations and assets, or to pursue remedies or limit damages.
